Blinkjoy Affiliate Program Terms and Conditions

Welcome to the Blinkjoy Affiliate Program. These Terms and Conditions ("Terms") govern your participation in the Blinkjoy Affiliate Program ("Program") operated by Blinkjoy, Inc. ("Blinkjoy," "we," "us," or "our"). By applying to and participating in the Program, you ("Affiliate," "you," or "your") agree to be bound by these Terms.
1. Eligibility
To participate in the Program, you must:
Be at least 18 years of age
Have an active website, blog, social media account, email list, or other content platform
Maintain content and an audience aligned with Blinkjoy's brand values (health, wellness, eye care, lifestyle)
Comply with all applicable laws, regulations, and platform policies
Provide accurate and complete information during application and throughout your participation
Blinkjoy reserves the right to approve or reject any application at our sole discretion and to terminate participation at any time.
2. Application and Approval
Submission of an application does not guarantee acceptance. We review each application based on content quality, audience fit, and alignment with our brand. Approved Affiliates will receive a unique tracking link and access to the Refersion affiliate dashboard.
3. Commission Structure
Commission rates are specified in your Refersion dashboard at the time of approval and may vary by program tier or campaign
Commissions are earned only on qualifying sales generated through your unique tracking link
A "qualifying sale" is a completed purchase made by a new or returning customer that is not refunded, returned, canceled, or fraudulent
Cookie attribution window: 30 days from the customer's last click on your tracking link
Commissions do not apply to: shipping charges, taxes, gift cards, subscription renewals (unless otherwise specified), wholesale orders, B2B clinic orders, or orders placed using unauthorized discount codes
Self-referrals and purchases made by the Affiliate or immediate family members are not eligible for commission
4. Payment Terms
Commissions are calculated and approved on a regular schedule as specified in the Refersion platform
Payout thresholds and payment timing are noted in your Refersion dashboard
Payments are made via PayPal or other methods supported by Refersion
Affiliates are responsible for providing accurate payment information and any required tax documentation (e.g., W-9 for U.S. residents)
Affiliates are solely responsible for any taxes owed on commissions earned
5. Promotional Guidelines
You may:
Share your unique tracking link on your website, blog, social media, email newsletters, and approved content platforms
Use Blinkjoy-provided creative assets, product images, and approved copy
Create authentic, original content featuring Blinkjoy products
Disclose your affiliate relationship in accordance with FTC guidelines and applicable laws
You may not:
Make false, misleading, or unsubstantiated claims about Blinkjoy products
Make medical claims, including but not limited to claims that Blinkjoy products diagnose, treat, cure, or prevent any disease or condition
Run any form of paid advertising promoting Blinkjoy or your affiliate link, including but not limited to Google Ads, Meta Ads, TikTok Ads, YouTube Ads, or any other paid media platform
Bid on Blinkjoy branded keywords (e.g., "Blinkjoy," "Blink joy," misspellings, or variations) in any paid search or paid social platform
Use Blinkjoy's trademarks, logos, or brand assets in domain names, social handles, or paid ad accounts
Engage in cookie stuffing, link cloaking, spam, or any deceptive marketing practices
Post your tracking link, affiliate code, or any Blinkjoy promotional codes on coupon websites, deal websites, cashback sites, discount aggregators, or similar platforms
Distribute unsolicited emails (spam) containing your affiliate link
Misrepresent yourself as an employee, agent, or official spokesperson of Blinkjoy
Promote Blinkjoy on websites containing illegal, offensive, discriminatory, or adult content
Violation of the paid advertising or coupon site policies may result in immediate termination from the Program and forfeiture of unpaid commissions.
6. Disclosure Requirements
You are required to comply with the Federal Trade Commission's Endorsement Guides and all applicable disclosure laws in your jurisdiction. This includes clearly and conspicuously disclosing your affiliate relationship with Blinkjoy in any content where you promote our products (e.g., #ad, #affiliate, "I earn a commission on purchases made through this link").
7. Intellectual Property
Blinkjoy grants you a limited, non-exclusive, non-transferable, revocable license to use Blinkjoy's name, logos, and approved creative assets solely for the purpose of promoting Blinkjoy products through the Program. All intellectual property rights remain the property of Blinkjoy. This license terminates immediately upon termination of your participation in the Program.
8. Medical and Regulatory Compliance
Blinkjoy products are not intended to diagnose, treat, cure, or prevent any disease and have not been evaluated by the U.S. Food and Drug Administration. Affiliates must not make medical, therapeutic, or disease-related claims about Blinkjoy products. All product claims must be consistent with claims approved by Blinkjoy and provided in our official creative assets and product descriptions.
9. Term and Termination
These Terms remain in effect for as long as you participate in the Program. Either party may terminate participation at any time, for any reason, with or without notice. Upon termination:
You must immediately cease using all Blinkjoy trademarks, creative assets, and tracking links
You must remove all Blinkjoy-related content from your platforms upon request
Any unpaid commissions earned prior to termination will be paid in accordance with Section 4, provided you have not violated these Terms
Blinkjoy reserves the right to withhold commissions in cases of fraud, policy violation, or breach of these Terms
10. Modifications
Blinkjoy reserves the right to modify these Terms, commission structures, cookie windows, or any aspect of the Program at any time. Material changes will be communicated via the Refersion dashboard or email. Continued participation after changes take effect constitutes acceptance of the revised Terms.
11. Confidentiality
You agree to maintain the confidentiality of any non-public information shared by Blinkjoy, including commission rates, sales data, upcoming product launches, and promotional plans, except as required for the legitimate promotion of Blinkjoy products.
12. Independent Contractor
You are an independent contractor and not an employee, agent, partner, or joint venturer of Blinkjoy. You have no authority to bind Blinkjoy or make representations on its behalf.
13. Limitation of Liability
To the maximum extent permitted by law, Blinkjoy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your participation in the Program. Blinkjoy's total liability shall not exceed the total commissions paid to you in the six months preceding the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Blinkjoy and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your breach of these Terms, your promotional activities, or your violation of any law or third-party right.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Diego County, California.

2. How We Use Your Information
We use your information to:
Evaluate and process your application to the Program. Manage your participation, including tracking referrals and calculating commissions. Process commission payments and issue tax documentation. Communicate with you about your account, payments, promotions, new product launches, and Program updates. Provide creative assets, promotional materials, and affiliate support. Monitor compliance with our Affiliate Program Terms and Conditions. Detect, prevent, and address fraud, security issues, and policy violations. Improve and optimize the Program. Comply with legal and regulatory obligations.
3. How We Share Your Information
We do not sell your personal information. We may share your information with the following parties:
Refersion: Our affiliate management platform, which processes Program data on our behalf. Payment processors: To facilitate commission payments (e.g., PayPal). Service providers: Including email marketing platforms, analytics tools, accounting services, and customer support tools that help us operate the Program. Legal and regulatory authorities: When required by law, subpoena, court order, or to protect our rights, property, or safety. Business transfers: In connection with a merger, acquisition, financing, or sale of assets, your information may be transferred as part of the transaction. We require all third parties to protect your information in accordance with applicable data protection laws.
4. Data Storage and Security

We retain your information for as long as you remain an active Affiliate and for a reasonable period thereafter to comply with legal, tax, accounting, and regulatory obligations, resolve disputes, and enforce our agreements. Tax-related records are typically retained for a minimum of seven years.

Access: Request a copy of the personal information we hold about you. Correction: Request correction of inaccurate or incomplete information. Deletion: Request deletion of your personal information, subject to legal retention requirements. Portability: Request your information in a portable format. Opt-out: Unsubscribe from marketing communications at any time. Objection: Object to certain types of processing. By participating in the Program, you acknowledge the use of these tracking technologies.

8. International Data Transfers
If you are located outside the United States, please note that your information may be transferred to, stored in, and processed in the United States or other countries where our service providers operate. The Program is not intended for individuals under the age of 18. We do not knowingly collect personal information from minors. If we learn that we have collected information from a person under 18, we will delete it promptly.
